Do the legs stay up while the tray is being carried by the handles, or do they fall by gravity?

No, the legs do not stay up. I have to fold them under the table and hold them there when carrying it. My invalid husband used the tray, which worked very well once I got it into place. He would help me out by holding the legs in place until I had the tray completely set down. I also used a piece of rubber-backed shelf paper to line the tray proper so that his dishes wouldn't slip around. (I see that this question was directed to my daughter, Susan Seeger, who did not purchase the tray. I am her mother and I purchased the tray for my husband to use as he was bedridden.)

Can this be used For much larger people

The legs are about a foot tall. If you needed to you could use it without the legs and set it directly on your lap. I've done it before and it works great. It's well made and sturdy when using the legs or without the legs.
